The crux of personal injury claims is proof of negligence. To support a legal claim for negligence, you must show: 

  1. that the person you are suing owed you a "duty of care" -- an obligation that a sensible person would use in the circumstances, when acting towards others;
  2. that the person you are suing failed to exercise due care towards you (i.e. breached the duty);
  3. that the resulting breach of duty caused you injury;
  4. and that you suffered damages as a result.

Our constitution was created to protect our civil rights as human beings and now the Appeals court rules California’s same sex marriage ban as unconstitutional. A three-judge panel of the 9th U.S. Circuit Court of Appeals ruled 2-1 that a lower court judge correctly interpreted the U.S. Constitution and Supreme Court precedents when he declared in 2010 that Proposition 8 was a violation of the civil rights of gays and lesbians.

Black Leaders Slam Chris Christie Over Civil Rights Comments

Two prominent African-American officials in New Jersey have harshly criticized Gov. Chris Christie for statements related to his proposal to put the issue of same-sex marriage to a popular vote in November.

Christie, a Republican, said that the leaders of the civil rights movement would have happily placed the causes they championed to a public vote. Earlier in the week, the governor proposed that same-sex marriage be decided by the voters.

“Dear God, we should not be putting civil rights issues to a popular vote, to be subject to the sentiments, the passions of the day,” Newark Mayor Cory Booker said. “No minority should have their rights subject to the passions and the sentiments of the majority. This is the fundamental bedrock of what our nation stands for.”

Booker said that under the proposal the governor offers, Jackie Robinson would not have been able to achieve the historic role as the first African-American player in major league baseball.

Similarly, Assembly Speaker Sheila Oliver took strong issue with Christie’s position. 

“Governor, people were fighting and dying in the streets of the South because the majority refused to grant minorities equal rights by any method,” Oliver said. “It took legislative action to bring justice to all Americans, just as legislative action is the right way to bring marriage equality to all New Jerseyans.”

In response, the governor defended his position and said that his intention was to offer a compromise on the highly controversial issue of same-sex marriage.

“I’m in divided government and I’m trying to find a way for people ... to find another pathway where everybody can have a chance to get what they want,” Christie said. “My view is a public referendum on a constitutional amendment regarding same-sex marriage is a way to get to that result.”

A bill to permit same-sex marriage was defeated in the state’s Senate two years ago. But the issue was reignited earlier this month when the Democratic-led Senate called it a priority for the new legislative session. Earlier, Christie said he would veto any bill that permitted same-sex marriage.

Six states and Washington, D.C., permit gay marriages. Additionally, 31 states have adopted constitutional amendments defining marriage as a union between one man and one woman.
On Monday, Gov. Christie appointed the first openly gay Black judge to New Jersey's State Supreme Court.

This week Mr. King discusses the recent abuse by the L.A. county Sheriffs department in the Mens County Jail. 

Jorge Rosales was only 18 years old when he unexpectedly passed away while being detained at the Los Angeles County Jail in the twin towers. Unfortunately he had a seizure, and the jail authorities tried to revive him but were unsuccessful which is what Jorge’s brother Gustavo Rosales said. The abuse of inmates at the LA County Jail seems to be becoming more commonplace these days. The FBI seems to be currently investigating these recent allegations of abuse and I believe they have reason to do so. The Rosales family attorney Luis Carrillo said that a LA County deputy punched him in the head just two days before he died. And although Rosales asked for medical care, he never apparently got any. There is been a fire under the sheriff’s department for some time regarding the treatment of prisoners inside the Los Angeles County jail. So far over 24 deputies have had some sort of disciplinary action taken against them for applying excessive force on inmates and for trying to cover up certain types of abuses that happens these inmates.

Anonymous take down Department of 

Justice, RIAA, MPAA, Universal Music posted by slashgear

Earlier today the sites Megaupload and Megavideo were shut down by ICE, a federal group responsible for working with and shutting down groups that pirate media illegally – in retaliation the hacker collective known as Anonymous have shut down the RIAA, the MPAA, Universal Music, and the United States Government site Justice.org, belonging to the Department of Justice. These hits have been confirmed by several anonymously run “official” Anonymous sources such as twitter accounts @Anonops,@AnonymousIRC, and @YourAnonNews, and were likely planned in advance. As a bit of an extra jab after the biggest sites in this situation were downed, Anonymous noted that they should simply say, “for #SOPA supporters their#SOPAblackout is today.”

You can check for yourself with several sites that check the network status of sites, RIAA.ORG is down for the count, Justice.org is no longer, http://universalmusic.com is nowhere to be seen, and the Motion Picture Association of America will be showing no films at the moment. Each of these groups had a part in knocking out Megaupload and certainly had a say in not only SOPA but PIPA as well. For those of you that don’t know, both bills are being heavily reconsidered now due to the massive dissent seen yesterday during the blackouts.

What this appears very much to be is the solidification of the internetization of justice on a grand scale. As AnonDaily reports, Anonymous has taken down 10 sites in 20 minutes and this is therefor the “Largest On Scale Attack Ever” by the group. We’ll see where this leads us in regards to fair sharing and trading of ideas on the internet from here on out when it hackers take command of the internet with their ability to take down any website, no matter who runs it, in no time flat.

Persons accused of committing a crime have a series of rights, some of which are guaranteed by the U.S. Constitution and some of which are guaranteed for other reasons. If you have been accused of a crime, how can you know if your rights have been violated? While an experienced criminal law attorney can answer that question, the following checklist of rights may also provide you with guidance.

I was allowed to remain silent: One of the most important rights of a person accused of a crime is the right to remain silent. You cannot be forced to divulge information to the police. This right stems from the Fifth Amendment right against self-incrimination. In other words, you are not required to prove your case for the police. They are responsible for developing the evidence to prove you have in fact committed a crime. The right to remain silent was confirmed in the U.S. Supreme Court case of Miranda v. Arizona. If you attempted to remain silent in the face of police questioning, and were coerced or forced into speaking, your rights have been violated.

I was told that anything I chose to say can be used against me: The police must inform you that if you chose to speak, "anything you do say may be used against you in a court of law." If you were told that you had the right to remain silent, but were not informed of the consequences of choosing to speak, your rights may have been violated.

I was allowed to have an attorney present when I requested one: Another absolute right of a person under arrest for a crime is the right to have an attorney present during questioning and the right to have counsel during any trial. If you requested an attorney during questioning, and the police denied you that request, your rights may have been violated.

I was not asked questions while my attorney was absent: Once you request the assistance of an attorney, the police are prohibited from questioning you later without your attorney. In other words, you have the right to have an attorney present during the first, and any subsequent, talks with the police.

I was not forced to pay for my attorney?s services: Just as you are entitled to have an attorney, you are also entitled to a state-paid and appointed attorney if you can not afford your own attorney per a state's or county's guidelines. If you fall within this category, you will be assigned a public defender to represent you.

Although I initially didn?t ask for an attorney, when I asked for one later in my questioning, questioning stopped and didn't start again until my attorney arrived: In many situations, criminal suspects may have false confidence that they can handle the matter on their own, without the assistance of an attorney. A criminal suspect who decides to answer police questions without an attorney present still has the right to ask for an attorney at any later point. Once a suspect asks for an attorney, all questioning must stop until the attorney arrives.

I was treated humanely: Unfortunately, police brutality and unfair treatment continue to occur in the United States. A criminal suspect is entitled to humane treatment, no matter how heinous the alleged crime. If you were not treated humanely, for instance if you were deprived of food and water or if you were beaten either during police questioning or while in a holding cell, your rights may have been violated
