- that the person you are suing owed you a "duty of care" -- an obligation that a sensible person would use in the circumstances, when acting towards others;
- that the person you are suing failed to exercise due care towards you (i.e. breached the duty);
- that the resulting breach of duty caused you injury;
- and that you suffered damages as a result.
